   You represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this Website.

Customer Responsibility: When buying an item, you agree that: (i) you are responsible for reading the full item listing before making a commitment to buy it: (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.

All descriptions of products and pricing are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, COMPASS MAP COMPANY'S AGGREGATE LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO $50. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU.

Except where prohibited by applicable law, and without limitation to any statutory rights for consumers, you agree that all disputes, claims and legal proceedings directly or indirectly arising out of or relating to the Website (including but not limited to the purchase of Compass Map Company products) shall be resolved individually, without resort to any form of class action, and exclusively in the state or federal courts located in Virginia, USA. These Terms may not be modified, supplemented, qualified, or interpreted by any trade usage or prior course of dealing not made a part of these Terms. The invalidity or unenforceability of any provision of these Terms shall not affect the validity of these Terms as a whole and any such provision should be enforced by authorities, and reconstructed if need be, to apply to the maximum extent allowable under applicable law. The failure by either party to enforce at any time any of the provisions of these Terms, to exercise any election or option provided herein, or to require at any time the performance of the other of any of the provisions herein will not in any way be construed as a waiver of such provisions. Reasonable attorneys’ fees and costs will be awarded to the prevailing party in the event of litigation involving the enforcement or interpretation of these Terms. The section headings used herein are for convenience only and shall not be given any legal import. Compass Map Company may assign its rights and duties under these Terms to any party at any time without notice to you, unless notice to you is required by applicable law, but this will not affect your rights or our obligations under these Terms. We may modify these Terms at any time, so be sure to check them regularly. By continuing to use the Website after these Terms have changed, you indicate your agreement to the revised Terms. Compass Map Company may revise these Terms of Sale without notice by posting revised Terms of Sale on its Website. The Terms of Sale posted on the Website at the time you place your order on the Website will govern that purchase. Please read these terms carefully and check that the details of your order are complete and accurate before submitting your order.

 

PLACING ORDERS ON THE WEBSITE

 

ELIGIBILITY TO ORDER
To place an order on the Website, you must be of legal age in your country and a consumer – not a reseller.

 

NO PURCHASE FOR RESALE
The Website is intended solely for Compass Map Company to sell Compass Map Company products direct to end consumers, and therefore purchase of products for resale is strictly prohibited. Purchase for resale means the purchase of Compass Map Company product by someone who resells, or intends to resell, the Compass Map Company product to others (consumers, businesses or any third party). If Compass Map Company believes you are involved in purchase for resale, Compass Map Company reserves the right to take any action against you, including, without limitation, to restrict sales to you, cancel your orders, and/or suspend or close your account.

 

HOW TO ORDER
We may require an e-mail address from you to place an order, and you may need to set your browser to accept both (functional) cookies and pop-ups in order to be able to use all the functionalities of the Website, which may include designing customized items, adding items to your shopping bag and submitting your order. You shall only provide accurate and complete information to Compass Map Company regarding your order, including but not limited to any payment, shipping, and contact information, and Compass Map Company shall have no liability or responsibility whatsoever for any costs or loss of product or services due to inaccurate or incomplete information.

An agreement for Compass Map Company to sell goods to you is made when we accept your order. The description of goods, price, and applicable tax are agreed on between you and Compass Map Company when an order is placed. You are responsible for the charges for transport, packaging, freight, and/or insurance of your order as reflected in the order summary provided upon checkout.

Placement of an order is a binding agreement. Once placed, all orders are considered final and you may not change or cancel them. Compass Map Company reserves the right to cancel any order for any reason whatsoever, including but not limited to unauthorized, altered, or ineligible use of an offer or payment. Compass Map Company reserves the right to modify or cancel a promotion due to system error or unforeseen problems.

You shall provide current, complete, and accurate information for all information submitted on, to, or through the Website, including but not limited to any information submitted for a purchase. You shall promptly notify us of any changes to any information you previously provided to us, including your email address and credit card numbers and expiration dates.

 

PAYMENT METHODS
We do not accept any method of payment other than those accepted on the Website during checkout. Please do not try to pay by any other way than specified there. If you do, we will not be liable for loss of the payment or any other damages that may result from this action.

 

Wix Payments and its affiliates process transactions (including payment transactions) for Compass Map Company in connection with orders placed by you.

 

TITLE TRANSFER & RISK OF LOSS
The title and risk of loss for products purchased from Compass Map Company pass to you upon our delivery to the carrier, provided that title to product will not transfer until full payment has been received.

 

SHIPPING & DELIVERY
Every product is made to order from our sustainably-sourced hard/softwood stock. Depending on authorization and verification of payment details, orders should ship within 2-4 weeks, but if we are experiencing a high volume of orders, public holidays, or any unforeseen events, shipments may be delayed. If there will be a significant delay in shipment of your order, we will try to contact you via email or telephone. Any shipping windows provided by us are only estimates and delivery dates cannot be guaranteed. Compass Map Company is not responsible or liable for any customs or taxes applied to your order. EXCEPT AS EXPLICITLY PROVIDED HEREIN, ALL SHIPPING CHARGES ARE NON-REFUNDABLE.

 

RETURN AND EXCHANGE POLICY

Each piece of wood behaves differently and each product that we create is unique.

• Natural Variation: Wood is a natural material, and each piece is unique. Variations in color, grain pattern, and texture are inherent characteristics and should be expected. These variations are not considered flaws or defects but are a natural result of the material and craftsmanship.

• Color Matching: The final product may differ in appearance from samples or product photographs due to the unique way each piece of wood absorbs finishes. We cannot guarantee an exact color match.

• Unique Character: Many of our pieces are handcrafted, and minor imperfections, such as small knots, holes, or variations in the surface, contribute to their unique charm and character. 

 

For all our standard product lines, if there are any errors or damages to your order, please contact compassmapco@gmail.com regarding your return and your reimbursement. In the event your claim is justified, the purchase price and the shipping costs (return shipping method to be selected at Compass Map Company’s discretion) will be refunded.

We do not accept returns of custom orders. For custom orders with errors or damages, please contact us and we’ll do our best to find an effective solution to your concerns.

 

INTELLECTUAL PROPERTY
Compass Map Company does not grant you any licenses, express or implied, to the intellectual property of Compass Map Company or its licensors, except as expressly stated in these Terms of Sale or as contained in a separate agreement between you and Compass Map Company. “Compass Map Company” and all associated logos displayed within the Website or any products sold on it are our trademarks and our copyrighted works (unless otherwise noted).

The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of Compass Map Company. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.

You recognize and agree that by uploading any content (including, but not limited to designs, images, animations, videos, audio files, fonts, logos, illustrations, compositions, artworks, interfaces, text and literary works) through any means to the website, you confirm that you own all the relevant rights or received the appropriate license to upload/transfer/send the content. You agree and consent that the uploaded/transferred content may be publicly displayed at the website.

To the maximum extent permitted by applicable law, Compass Map Company assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.

 

EVENTS OUTSIDE OUR CONTROL
An Event Outside Our Control means any act or event beyond our reasonable control, including without limitation strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic, pandemic, or other natural disaster, or failure of public or private telecommunications networks.

 

If an Event Outside Our Control takes place that affects the performance of our obligations under these Terms of Sale, our obligations under these general conditions will be suspended and the time for performance of our obligations will be extended for the duration of the Event Outside Our Control.

 

OTHER IMPORTANT TERMS
The laws of the State of Virginia, excluding its conflict of law principles, govern these Terms of Sale. Except where prohibited by applicable law, and without limitation to any statutory rights for consumers, you agree that all disputes, claims and legal proceedings directly or indirectly arising out of or relating to these Terms of Sale shall be resolved individually, without resort to any form of class action, and exclusively in the state or federal courts located in Virginia, USA. We may transfer our rights and obligations under a contract to another organization, but this will not affect your rights or our obligations under these Terms of Sale. You may only transfer your rights or your obligations under these Terms of Sale to another person if we agree in writing. Each of the paragraphs of this Terms of Sale operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect. If we fail to insist that you perform any of your obligations under these Terms of Sale, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you. We will not file a copy of the contract between us.
